Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PestAmigo platform — the website, mobile experience, and related services (collectively, the "Service") operated by PestAmigo, LLC ("PestAmigo," "we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are and what we do

PestAmigo is a marketplace that connects residential customers with independent, licensed pest-control operators (individuals and companies) for same-day and recurring pest-control services. PestAmigo is not a pest-control company and does not perform pest-control services. The licensed operator who accepts your booking is the party providing the service.

2. Eligibility

You must be at least 18 years old and able to enter into binding contracts to use the Service. By using the Service, you represent and warrant that you meet these requirements and that the information you provide is accurate.

3. Accounts

To book a service or operate on the platform, you must create an account. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately at support@pestamigo.com if you suspect unauthorized use.

4. Booking, pricing, and payments

Same-day pest-control services are priced at a base of $120, with adjustments disclosed at booking for larger homes or specialized treatments (rodents, bed bugs, German cockroaches). Recurring services are priced separately at the rates posted on the Service.

  • A booking fee is collected at the time of booking and is non-refundable except as set out in Section 6.
  • The remaining service balance is charged to the card on file after the operator marks the job complete.
  • All payments are processed by Stripe, Inc. Your use of payment features is subject to Stripe's terms.

5. Service window and dispatch

You select a four-hour service window during booking. PestAmigo dispatches the booking to qualified operators in your area; the first operator to accept the job is the operator who will service your property. Operator availability and timing are not guaranteed but we endeavor to fulfill your selected window.

6. Cancellations and refunds

You may cancel a booking from your account at any time prior to the operator marking the job in progress. Cancellations made:

  • Before an operator has accepted are refunded in full, including the booking fee.
  • After an operator has accepted but before the service window begins are refunded in full minus the booking fee.
  • After the service window has begun or after the operator has marked the job in progress are non-refundable, except as required by law.

If your service is materially deficient, contact us within 7 days and we will work with you and the operator on a remedy, which may include a free re-treatment, partial refund, or full refund at our discretion.

7. Independent operators

Operators on the Service are independent contractors — not employees, agents, or partners of PestAmigo. PestAmigo does not control how, when, or with what tools an operator performs a job, beyond the platform-level standards each operator agrees to in the Operator Agreement.

8. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Misrepresent your identity, your property, or the nature of the pest activity.
  • Harass, threaten, or discriminate against any operator or other user.
  • Circumvent the platform — for example, by paying an operator off-platform after they were dispatched to you through the Service.
  • Reverse engineer, scrape, or interfere with the Service.

9. SMS and email communications

By providing your phone number, you consent to receive transactional SMS messages from PestAmigo, including authentication codes, dispatch notifications, and service updates. Standard message and data rates may apply. Reply STOP to opt out of non-essential messages; certain transactional messages (authentication, payment receipts, service confirmations) are required for account use.

10. Customer data and privacy

Our handling of personal data is described in our Privacy Policy. Your service address and contact information are shared with the operator assigned to your job.

11. Disclaimers

THE SERVICE AND THE PEST-CONTROL SERVICES PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PESTAMIGO DOES NOT WARRANT THAT PEST ACTIVITY WILL BE ELIMINATED OR THAT SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PESTAMIGO'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID PESTAMIGO IN THE 6 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) $100. PESTAMIGO IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

13. Indemnification

You agree to indemnify, defend, and hold harmless PestAmigo and its officers, directors, employees, and contractors from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your breach of these Terms, or (c) your violation of any applicable law.

14. Disputes and arbitration

Most concerns can be resolved by contacting support@pestamigo.com. Any dispute that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and PestAmigo each waive the right to a jury trial and the right to participate in any class action. Either party may bring claims in small-claims court if eligible.

15. Governing law

These Terms are governed by the laws of the State of Utah without regard to its conflict-of-laws principles. Subject to Section 14, any action shall be brought exclusively in the state or federal courts located in Utah County, Utah.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the version date above. Material changes will be brought to your attention via the Service or by email; continued use of the Service after the effective date constitutes acceptance of the updated Terms.

17. Termination

We may suspend or terminate your access to the Service at any time for breach of these Terms or for conduct that we reasonably believe is harmful to other users, operators, or PestAmigo. You may close your account at any time by contacting support.
